DAÑO EN BIEN AJENO. El que destruya, inutilice, haga desaparecer o de cualquier otro modo dañe bien ajeno mueble o inmueble, siempre que el hecho no constituya delito sancionado con pena mayor, incurrirá en prisión de uno (1) a cinco (5) años y multa de quinientos a diez mil pesos. Si el responsable resarciere el daño ocasionado al ofendido o perjudicado, podrá el juez prescindir de la aplicación de la pena.
