ARTICULO 42

Comunicación en caso de arresto, detención, preventiva o instrucción de un procedimiento penal.

Cuando se arreste o detenga preventivamente a un miembro del personal consular, o se le instruya un procedimiento penal, el Estado receptor estará obligado a comunicarlo sin demora al jefe de oficina consular. Si esas medidas se aplicasen a este último, el Estado deberá poner el hecho en conocimiento del Estado que envia, por vía diplomática.
