El demandado puede probar contra la presunción de verdad de los hechos en el caso de que por no haber contestado deban tenerse como ciertos. También puede rescindirse esta presunción en el curso del juicio, como en el caso de posiciones, y decretada, se restituirá al demandante en el término de pruebas.
