No habrá lugar a la legalización de explotaciones mineras que a juicio de la entidad competente sean consideradas manifiestamente inseguras, presenten peligro inminente para la vida de los mineros o cuando la autoridad ambiental no autorice la actividad, se hayan formulado sobre áreas restringidas para la minería o de reserva especial o la autoridad ambiental no autorice la actividad, dadas las condiciones ambientales de la zona.
