ARTICULO 105 . Procedimiento en caso de impedimento . En el mismo auto en que el funcionario judicial manifieste el impedimento pasará la actuación a otro funcionario judicial que le siga en turno o a otro del lugar más cercano, si en el sitio no hubiere más de uno de la categoría del impedido, o todos estuvieren impedidos. En caso de presentarse discusión sobre el funcionario a quien corresponda continuar el trámite de la actuación, decidirá de plano el superior de quien se declaró impedido. Para tal efecto, el funcionario que tenga el expediente enviará el cuaderno de copias a la autoridad que deba resolver lo pertinente.
