El Fondo para la Modernización, Descongestión y Bienestar de la Administración de Justicia será administrado por el Consejo Superior de la Judicatura, o quien haga sus veces, a través de una fiduciaria. Para tal efecto, el Consejo Superior de la Judicatura, o quien haga sus veces, contratará la fiducia. El valor de la comisión fiduciaria se pagará con cargo a los rendimientos financieros producidos por los recursos administrados.
