Instalado el Consejo, se notificará al reo que nombre defensor. Posesionado éste, se harán comparecer todos los testigos que de antemano deberán ser citados, y se traerán las demás pruebas pertinentes que hubiere.

En este caso, el nombramiento de defensor podrá recaer en un Oficial de cualquier grado, quien está en la obligación de desempeñar el cargo.
