Caso de no conformarse el expropiado ó el Fiscal con la fijación del valor y las indemnizaciones decretadas por el Juez en calidad de provisionales, estará obligado el primero a recibir la suma decretada, sin perjuicio de seguir un juicio ordinario, que tenga por objeto probar la deficiencia ó exceso de la cantidad acordada, como total indemnización, y en el cual representara los intereses de la vía férrea el Agente del Ministerio público.
