Se prohíbe constituir usufructo alguno bajo una condición o a un plazo cualquiera que suspenda su ejercicio. Si de hecho se constituyere, no tendrá valor alguno.

Con todo, si el usufructo se constituye por testamento, i la condición se hubiere cumplido, o el plazo hubiere espirado antes del fallecimiento del testador, valdrá el usufructo.
