Si una de las partes pidiere que un testigo residente en otro lugar sea examinado por el Juez de la causa, y garantizare indemnizarlo todo perjuicio, se accederá a su solicitud; pero el Juez no dará la orden de hacer concurrir el testigo mientras no se consigne lo que provisionalmente se calcule que debe dársele.
