Los inversionistas extranjeros podrán conservar su participación porcentual en el capital de las entidades financieras, o mantener la que llegaren a poseer, para lo cual el Departamento Nacional de Planeación, podrá aprobar la inversión que corresponda a aumentos de capital con sujeción al derecho de preferencia, aun cuando se exceda el límite de que trata el artículo 5° de la presente Ley.
