No se pueden adjudicar como baldíos las partes de las montañas circunvecinas de los ríos que proveen de agua potable a las poblaciones de importancia. La defensa de esos ríos y la reglamentación de los desmontes y cultivo de las tierras baldías adyacentes corresponde a los Concejos de los respectivos Municipios.
