Es entendido que lo dispuesto en el artículo 1° del presente Decreto no afecta las exenciones, de que gozan por disposiciones legales, distintas de la del artículo 5° de la Ley 36 de 1940, los legados hechos por el mismo testador con fines de asistencia social, de instrucción o higiene públicas y de adelanto o difusión de la ciencia en el país.
