Art. 374. Interpuesto en tiempo oportuno y por persona hábil recurso de casación contra una sentencia da las mencionadas en los artículos 366 y 367 de esta ley, el Tribunal lo concederá el concurre además las circunstancias seguidas de las expresadas en el artículo 366 no es potestativos del Tribunal ocuparse en apreciar las otras de circunstancias consignadas en el mismo artículo 366, ni declarar cosa alguna respecto de las causales que dan derecho a interponer el recurso.
