Legitimación

Ley 2524 de 2025 · por medio de la cual se establece el procedimiento especial administrativo y judicial para la restitución internacional y/o garantía del derecho de visitas de niños, niñas y adolescentes.

Toda persona, institución u organismo nacional o extranjero que pruebe que un niño, niña o adolescente menor de dieciséis (16) años ha sido objeto de un traslado o retención ilícita internacional y que demuestre un interés legítimo será titular de la acción de restitución.

Estará legitimada pasivamente la persona que haya sido denunciada por el traslado o la retención ilícita del niño, niña o adolescente menor de dieciséis (16) años, constituyéndose en la causa de la solicitud.
