Resuelta la controversia de conformidad con el aforo o el valor establecidos por la respectiva administración de aduana, el depósito adicional será aplicado al pago de los derechos correspondientes. El diez por ciento (10%) excedente ingresará al Tesoro Nacional como sanción por declaración incorrecta. Si la controversia fuere resuelta de acuerdo con el aforo o el valor declarado por el importador o su agente de aduana, se ordenará la devolución del depósito adicional constituido.
