Dentro de los términos del artículo 290 del Código de Procedimiento Penal, el funcionario de Policía Judicial que hubiere practicado la diligencia a que se refiere el artículo anterior, enviará la actuación al Juez Instructor, quien al día siguiente de recibirla, practicará, con la presencia de un agente del Ministerio Público, una diligencia de Inspección Judicial. Una vez hecha la inspección, el Juez tomará una muestra de la droga decomisada y la enviará a la Seccional más próxima del Instituto de Medicina Legal, a fin de que se haga una nueva peritación. Inmediatamente ordenará y presenciará la destrucción del remanente y sentará el Acta respectiva, que suscribirán el Agente del Ministerio Público y las demás personas que hayan intervenido en la diligencia.
