Art. 2.° Cuando el militar que falleciere sea el Jefe de la Compañía, piquete, Batallón ó Cuerpo de Ejército, las diligencia de que trata el artículo anterior se practicarán en la forma que queda indicada, por el Jefe ú Oficial á quien por sucesión de mando le corresponda asumir la funciones que el difunto ejercía.
