º Mientras subsista turbado el orden público y en Estado de Sitio el territorio nacional, quienes se hallen sindicados de hechos punibles de competencia de la Jurisdicción de Orden Público, no serán acreedores a la libertad inmediata a que se refiere el artículo 395 del Código de Procedimiento Penal, Decreto 050 de 1987. Recibida la indagatoria el Juez comunicará al respectivo nominador acerca de tal circunstancia, a fin de que se tomen las medidas necesarias para proteger el servicio público a cargo del empleado oficial.
