Mientras la solicitud de legalización presentada por explotadores de minas de propiedad estatal sin título minero inscrito en el Registro Minero Nacional no haya sido resuelta por la autoridad minera delegada competente, no habrá lugar a suspender las labores de explotación, a decomisar el mineral explotado, ni a proseguir la acción penal a que se refiere el artículo 338 de la Ley 599 de 2000 (Código Penal). Lo anterior, sin perjuicio de las acciones que sean aplicables en virtud de la normatividad ambiental vigente.
