Si al tiempo de hacerse la entrega se encuentra en la habitación una persona enferma cuya vida peligre sise le saca de allí, el Juez o el empleado de Policía que practica la diligencia, cerciorado del hecho por el dictamen de facultativos o de peritos comunes nombrados por él, debe suspender la diligencia por el menor término que a su juicio sea necesario mientras subsista la situación indicada.
