Remisión y fallo . Perfeccionada la investigación el expediente deberá ser remitido a la Capitanía de Puerto de Primera Categoría a la cual corresponde cerrarla y fallarla en primera instancia. Este expediente deberá remitirse a más tardar cuatro (4) meses después de que se dicte el auto por medio del cual se declara abierta la investigación. Si la remisión se produjere después de este término, este hecho no constituirá causal de nulidad, pero acarreará las sanciones disciplinarias que fuere del caso.
