Se garantizarán las obligaciones contraídas por el contratista con un fiador que sea persona de reconocida honorabilidad y solvencia; que tenga las condiciones legales para obligarse como tál; que se obligue mancomunada y solidariamente y renuncie expresamente al beneficio de excusión, fianza que prestará por una suma proporcional fijada en cada caso por el Ministro.
