Debe entenderse que el derecho de servidumbres que en los baldíos nacionales la ley ha consagrado expresamente en favor de los particulares, ha cobijado y cobijará también a la Nación respecto a todas aquellas fajas de terreno que necesite para que sus vías nacionales, departamentales o municipales, que no hayan de atravesar predios adjudicados o que en los sucesivo se adjudiquen.
