Si la lesión produjere la perturbación funcional transitoria de un órgano o miembro, la pena será de dos (2) a cinco (5) años de presidio y multa de doscientos ($ 200.00) a cuatro mil ($ 4.000.00) pesos. Si la perturbación funcional o psíquica fuere permanente, la pena será de dos (2) a seis (6) años de presidio, y la multa de doscientos ($ 200.00) a cinco mil ($ 5.000.00) pesos.
