El régimen sancionatorio en materia de seguridad minera es el previsto en el Código de Minas. Cuando el responsable de la exploración o explotación objeto de medida preventiva sea explorador o explotador ilícito, aplicada la medida se informará inmediatamente sobre tal circunstancia al Ministerio de Minas y Energía.
