El que estando encargado de suministrar a las tropas víveres, municiones u otros efectos, deje de hacerlo maliciosamente, será castigado con la pena de tres a seis años de prisión militar.

Si sólo hubiere habido descuido O negligencia en el proveedor, la pena será de seis meses a un año de prisión militar.
