El instrumento es pagadero al portador:

1° Cuando se expresa así en el instrumento;

2° Cuando debe pagarse a una persona determinada o al portador;

3° Cuando es pagadero a la orden de una persona supuesta o que no existe y este hecho es conocido de la persona que hace pagadero el instrumento en esa forma;

4° Cuando el nombre del beneficiario no corresponde al de persona alguna, o

5° Cuando el único o último endoso es en blanco.
