Las únicas causales de Impedimento o recusación en las causas militares son:

1.

El parentesco de consanguinidad dentro del cuarto grado o de afinidad dentro del segundo grado, entre el Vocal o juez y el procesado.

2.

La enemistad grave entre el Vocal o Juez y el procesado.

3.

Tener interés directo en la causa o haber declarado como testigo sobre el hecho motivo del proceso.
