Article 37

Facultad Para Actualizar El Estatuto Tributario

Ley 49 de 1990 · por la cual se reglamenta la repatriación de capitales, se estimula el mercado accionario, se expiden normas en materia tributaria, aduanera y se dictan otras disposiciones.

De conformidad con el numeral 12 del artículo 76 de la Constitución Política, revístese de facultades extraordinarias al Presidente de la República hasta el 31 de diciembre de 1993, para actualizar las veces que fuere necesario, el Estatuto Tributario establecido en el Decreto 624 de 1989.

Esta facultad se ejercerá con las siguientes condiciones:

1.

Los decretos extraordinarios mediante los cuales se ejerzan estas facultades, incorporarán como parte del Estatuto Tributario las normas legales en esta materia que hubieren sido expedidas por fuera del mismo.

2.

En virtud de esta facultad se podrán renumerar los artículos, o incluir como artículo, inciso, parágrafo, numeral o literal adicionales, las nuevas normas; así como suprimir las que hubieren sido derogadas, subrogadas, repetidas o modificadas.

3.

Podrá igualmente reescribirse el texto de las distintas normas sin cambiar el sentido de las mismas.
