Cuando en el proceso aparezca plenamente comprobado el cuerpo del delito y resultare, por lo menos, una declaración de testigo que ofrezca serios motivos de credibilidad conforme a las reglas de la critica del testimonio o graves indicios de que el procesado es responsable penalmente, como autor o participe, del hecho que se investiga, el juez dictará auto de proceder.
