En el caso de que el titular de una propuesta que haya sido publicada y anunciada, muera, la abandone o desista de ella cuando esté ya corriendo cualquiera de los términos de dos (2) años de que trata el inciso último del artículo 5º de la Ley 160 de 1936, sin que se hubiera anunciado el correspondiente juicio ordinario, se extinguirá dicha propuesta y se reputará no haber transcurrido término alguno. En consecuencia, el opositor vencido o el presunto dueño podrán oponerse o iniciar el juicio ordinario si se presentare una nueva propuesta que comprenda el terreno de que se reputan propietarios. Los juicios iniciados continuarán en curso.
