La sustitución de un nuevo deudor a otro no produce novación, si el acreedor no espresa su voluntad de dar por libre al primitivo deudor. A falta de esta espresión se entenderá que el tercero es solamente diputado por el deudor para hacer el pago, o que dicho tercero se obliga con él solidaria o subsidiariamente, según parezca deducirse del tenor o espíritu del acto.
