IMPEDIMENTOS Y RECUSACIONES. Los funcionarios designados para adelantar procesos disciplinarios o competentes para imponer sanciones disciplinarias deben declararse impedidos y pueden ser recusados en los siguientes casos

Cuando ellos o su cónyuge tengan algún parentesco dentro del cuarto grado de consanguinidad, segundo de afinidad o primero civil con el investigado;

Cuando sean acreedores, deudores o socios del Investigado;

Cuando en alguna forma hayan intervenido o emitido concepto en el caso y en relación con los hechos investigados;

Cuando exista enemistad grave o amistad íntima con el investigado.
