El propietario del terreno en que se cultiven las plantas a que se refiere el artículo 37, incurrirá en multa igual al valor del avalúo catastral del inmueble, a menos que demuestre que a pesar de haber puesto suma, diligencia y cuidado de la vigilancia de su predio, no pudo tener conocimiento de la destinación ilícita del mismo. Si es responsable de la conducta descrita en el artículo 37 fuere propietario del terreno donde se cultiven las plantas allí señaladas, la pena de multa a que tal norma se refiere será igual al avalúo catastral del inmueble.
