Si la sentencia declara la extinción del dominio de los bienes y éstos no estuvieren en poder del Estado, ordenará su entrega definitiva a quien corresponda y, ejecutoriada, comisionará para la diligencia que se practicará de preferencia por el comisionado dentro de los diez (10) días siguientes a la providencia respectiva.
