La extradición se concederá u ofrecerá de acuerdo con los tratados públicos. A falta de tratados públicos, el gobierno ofrecerá o concederá la extradición conforme a los trámites establecidos en el Código de Procedimiento Penal y previo dictamen favorable de la Corte Suprema Justicia en el segundo caso.
