Las circunstancias personales que disminuyan o excluyan la responsabilidad, no se tendrán en cuenta sino respecto del autor o del cómplice en quien concurran. Tampoco se tendrán en cuenta aquellas cuyo efecto sea agravar la sanción, a menos que hubieren sido conocidas por el partícipe; pero en este último caso podrá disminuirse tal agravación hasta en una sexta parte.
