° Cuando el propietario demuestre haber obtenido en su predio una productividad superior a los niveles mínimos de productividad fijados por el Ministerio de Agricultura, el derecho de exclusión de que trata el artículo 3° se aumentará en un porcentaje igual a la productividad excedente que se hubiere acreditado.
