CESACION DE PROCEDIMIENTO. En cualquier estado del proceso en que aparezca comprobado que el hecho imputado no ha existido, o que el procesado no lo ha cometido, o que la conducta es atípica, o que se obró dentro de una causal excluyente de antijuridicidad o de culpabilidad, o que el proceso no podía iniciarse o no puede proseguirse, el juez, mediante auto, interlocutorio así lo declarará.
