Este organismo se constituye con cinco miembros, que serán elegidos y nombrados en la siguiente forma: uno elegido por el Senado de la República y otro por la Cámara de Representantes; dos nombrados por el Gobieno y otro designado por el Consejo de Estado. el Ministro de Minas y Petróleos propondrá al Consejo tecnico asesor los asuntos que el Gobieno someta a su estudio; y en dicho organismo tendrán voz todos los Ministros de Despacho.
