° De conformidad con los mandatos del artículo 9o. de la ley 23 de 1916, sobre nombramientos y ascensos, toda vacante de un puesto de oficial superior u oficial general en el ejército, se llenara ascendiendo al oficial en servicio activo que reúna las mejores condiciones para ello, de conformidad con las disposiciones vigentes sobre la materia, o llamando al servicio activo a un oficial del grado correspondiente que se halle en retiro temporal y reúna las mejores condiciones para ocupar el puesto vacante, al tenor de lo estatuido en el citado artículo 9°.
