Para anular un dictamen por error esencial se necesita el dictamen de peritos en número suficiente para formar mayoría, principiando por dos. Si con tres peritos en la acción rescisoria no llegare a formarse mayoría, se declarará inadmisible dicha acción, sin más actuación.
