B. Hurto de uso . Cuando el apoderamiento de que trata el artículo anterior se cometiere con el fin de hacer uso de la cosa, y esta se restituyere en término no mayor de veinticuatro (24) horas, la pena será de prisión de dos (2) a seis (6) años.

Cuando la cosa se restituyere con daño o deterioro grave, la pena se aumentará hasta en la mitad.
