Cesantía. A partir de la vigencia de este Estatuto, el Oficial o Suboficial de las fuerzas Militares que sea retirado o se retire del servicio activo por cualquier causa, tendrá derecho a que el Tesoro Público le pague, por una sola vez un auxilio de cesantía igual a un mes de los haberes correspondientes a su grado por cada año de servicio o fracción de seis (6) meses o más, tomando como base las partidas señaladas en el Artículo 116 y a las indemnizaciones que por incapacidad le puedan corresponder liquidadas igualmente conforme al Artículo 116 de este Decreto.
