Cuando un establecimiento público liquide déficit fiscal, el representante legal y la Junta Directiva incluirán forzosamente la partida necesaria para saldarlo. Sin el cumplimiento de este requisito la Dirección General del Presupuesto devolverá el proyecto para que se subsane o hará de oficio el ajuste correspondiente.
