En los casos de declaratoria de desierta de la licitación o concurso, cuando no se presente propuesta alguna, ninguna propuesta se ajuste al pliego de condiciones o términos de referencia o, en general, cuando falte voluntad de participación, la entidad estatal podrá contratar directamente, sin necesidad de obtener previamente ofertas, teniendo en cuenta los precios del mercado, y si es del caso, los estudios y evaluaciones que para el efecto se hayan realizado directamente o a través de organismos consultores o asesores designados para ello.
