ARTICULO 52 . Archivo definitivo. En cualquier estado del proceso, cuando aparezca plenamente probado que el hecho imputado no ha existido, o que el investigado no lo cometió o que la ley no lo considera como infracción disciplinaria, o que la acción disciplinaria no podría iniciarse o proseguirse, se ordenará mediante providencia motivada, proferida por quien ordenó la investigación el archivo definitivo del expediente.
