ARTICULO 39 . Auto inhibitorio. En el evento de que no se hubiere podido establecer los requisitos para la apertura de la investigación, previo concepto de investigador, el funcionario que la ordenó dictará auto inhibitorio. El auto inhibitorio no hará tránsito a cosa juzgada, pudiendo adelantarse proceso disciplinario cuando se encuentren nuevos hechos o pruebas que constituyan mérito suficiente para ello y siempre que la acción no se haya extinguido.
