ARTICULO 43. El artículo 190 del Código Contencioso Administrativo quedará así: "Artículo 190. NECESIDAD DE CAUCIÓN. El Ponente, antes de resolver sobre la admisibilidad de la demanda, determinará la naturaleza y la cuantía de la caución que debe constituir el recurrente, en el término que al efecto le señale, para garantizar los perjuicios que pueda causar a quienes fueron partes en el proceso. Si la caución no se presta oportunamente, se declarará desierto el recurso. Las entidades públicas no están obligadas a prestar caución".
